Local thugs obtain land the old fashioned way: they use VIOLENCE! It’s a cheaper and acceptable form of land acquisition, just seize foreigner’s land! Foreigners have no rights in Sonora!

On July 16, 20008 an administrative complaint was filed against the state prosecutor in Hermosillo for derelection of duty.

This is the same state prosecutor that evicted 400 squatters in February of this year without an investigation!!!!

Appeal update. The court system in Sonora is in a two week recess. My case is scheduled to be ruled on when they get back. They will decide if we are entitled to get our land back or if the criminals still get to keep it!

We had face to face cross examination where I got to prove beyond any reasonable doubt, that these criminals were not only the intellectuals behind the violent act of throwing us off our land, but they actually admitted to the type of weapons they used to keep me from stopping them. I will post a picture by thursday of them and their weapons. Additionally, they DENIED NOTHING, they just insisted that they were there to be witnesses so that I wouldn’t exagerate my claims! I will post transcript of the hearing as well.

Today was the first day of the new judge that was sent to replace the disgraced prior judge that gave away possession to our lands. I have not met him yet buyt hope to do so soon.

Judge gives away our land even though he knew criminal matter was ongoing and squatters had been evicted from the land! If you think this could not happen to you keep reading! What good is it to be “Legal Owner” when the people that were given possession are in POSSESSION and NEVER have to leave!!! So what if they can’t sell it, we can’t do anything with the land; not sell, not build, not anything….!

This is the criminal case where the same judge recused himself but later gave the defendants possession of our land! (same people, same plot of land , same judge!)
Different day; same nonsense!!
For those of you that were still believing that it was safe to invest in Sonoran Real Estate, I would carefully analyze my case because, this could be happening you!!!! Sad thing is there is not a damn thing you can do about it once it starts but go through every hoop they throw at you and be prepared for the next hoop because they hit you from ALL SIDES!
The documents are in Spanish but it makes for great reading entertainment because ALL declarations are FALSE and documents are fraudulent / doctored /fake! Bad thing about it is that this judge KNEW that these cases should have had the registered LEGAL owners notified to contest the court actions!!! I guess in Sonora you don’t have to notify the other party.
Why the hell did we have to invest in Sonora? Well the sky only appears to be blue in Sonora; it’s actually not blue, its a mirage just like the laws of this state!!! Spilled milk now. Now I have to get out of this predicament!
When will Governor Bours say “Enough is enough!!! Let’s enforce our current state laws and let the chips fall where they may!!!”

June 5, 2008 and Arrest warrants still not executed. Thugs freely walk the streets, nobody bothers them even though all 3000 residents of this tiny port village know these thugs have arrest warrants for them!
I would like to publicly thank all of you who have offered suggestions on how to defend myself in the Mexican system of law. However, My President George W. Bush said I was not allowed to print dollar bills with my computer at home and Gov. Arnold Schwarzenegger recently said California has fallen officially into drought and I am not allowed to water the dollar trees I had planted in my backyard! So, unless there is a rich, kind person that wants to contribute to this lone crusader’s fight against the unjust Mexican system I am battling, I have to do it the hard way. It only takes money! Money and patience two of the major components I am running really low on!
For those of you that write to me in Spanish and try to insult me with words like Yankee Imperialist, I must tell you I am a Dodger and a Laker fan not a Yankee fan. Besides, half the time I dont understand your insults. You have to use Spanish a third grader will understand and I am tired of using a dictionary to figure out what you are trying to say. I would write this in Spanish but you will have to wait until I finish the Spanish version of this blog; it’s is under construction.
Tonight I will post the trial pages of the three new owners to our land. I will also post the prior connection of the judge to our case where he recused himself because his friend was an adviser to the defendants! He can’t claim he didn’t know about the litigation or that these people were legally evicted and that one lady sought an an AMPARO with the same Fraudulent papers and lost!!! Fed Ex gets here around 2 – 3 pm they should up by 5 or 6!!!
News flash. We lost a court case we didn’t even know was going on! A local civil judge in the City of San Luis Rio Colorado has awarded TITLE to our land to the squatters because they sued for possession and judge doesn’t know what laws are about or he simply does not know the law. How did I find out that there were “NEW” owners to our land? They presented their new title to the municipal water company that promptly gave them water service!!!!!!!
We didn’t know about this prescriptive lawsuit!
Nothing new to report on the appeal. It is STILL is in transit to the Appellate Tribunal of Caborca. Nothing to do but sit back and hopefully justice will prevail!
Hearings are to be held with bench warrants being issued for the squatters / witnesses / victims because they have NOT bothered to show up to court at all.
A new owner has emerged from the abyss with an old title dating back to 1947! Wow!!!! Only in Mexico!!
On April 9, 2008 I was allowed a meeting with the President of the Tribunals for the State of Sonora (aka Chief Justice). He listened to my rants and committed to giving me a fair process. Can’t ask for more than that, if fact that’s all I ever asked for , “A fair shake!” My biggest complaint was that my side was NOT allowed to be present when the judge did the “Judicial Inspection”!
I also spoke with the Director of State Investigators and told him my story again. He committed to speaking persononally with the attorney general about restitution through the investigator and the execution of the arrest warrants. I have not been able to get through to him via telephone; he is always in a meeting or out of town.
The waiting game is in full press! We hurry up and wait@!!! Then we wait some more!!!
April 1, 2008 @ 10:30 am, an evidentiary hearing was held to determine if we have a right to get our land back with full legal and physical restitution or if the thugs have a right to continue to break the law and stay on our legally purchased and paid for property! No documentation was provided by the hoodlums / criminals. We await the ruling!
April 2, 2008; No ruling yet. However, the criminals on trial for throwing us off our land presented a motion to the judge stating that they have no connection with the squatters on our land and they had nothing to do with throwing us off our land and they are guilty of nothing except for harassment from my first lawyer that framed them!!
Ruling date has been set for Friday April 4, 2008 to determine if we get our land back or not. Stay tuned……..

Judges reasoning for not giving us back our land. He states that when HE (the Judge) made a physical inspection, he did not find any of the defendants on the property. Of course he wouldn’t find any of the defendants on our property because that is part their liberty bond to stay away from our property but they send in some poor ignorant people to squat the land for them!!!!! They were evicted once before and defied the order and went back on the land. The judge knew this fact because it is in the FILE!!! These people went as far as to get a ferderal AMPARO against the state so they wouldn’t get kicked off again and they LOST that motion as well, fraudulent papers and all. What a racket!
As soon as I can track down that fraudulent amparo I will post so the judge can read it AGAIN because it is in the FILE!!
This is the same judge that denied my motion for an order of police protection!
An appeal has been filed against this INSANE ruling! Last time we were there, the lower court ruling was overturned and arrest warrants issued. Why do I continue the fight, many have asked? Because I have to! There are many people within the Sonora government that are as appalled at our situation and they give me the emotional support to continue on.
