I would like to thank Lic. ABCD EFGH from Bahia de Kino, for scanning the State of Sonora Penal Code for the crime of Despojo and E-mailing it to me. She states that she is embarrassed that this can be happening to foreign investors in her beautiful country but more importantly her home state of Sonora! She also states that they had similar problems in San Carlos and Puerto Penasco when it started to get popular.
This is a direct copy of the current penal code for the State of Sonora defining “DESPOJO” I have googled and asked around for a direct translation for the word DESPOJO but havent really found one in English. In a nut shell, it is a crime when you deprive a LEGAL OWNER of their land by what ever means. Clearly, as evidenced in our case one cannot conclude that we were not deprived of our land when VIOLENCE was used by these terrorists to steal our land and throw us off.
If the videos and the pictures and testimony presented during the process was not enough to convince the judge that they had clear intent, motive and means to carry out this crime, then I must be imagining that this crime actually occured and the almost four years and the $300,000 I have spent so far trying to get our land back is just a figment of my crazy imagination.
I will asking for a COMPLETE copy of the court file so I can scan and post if here so that everybody can see the damming evidence that the judge ignored when he finalized his conclusion that NO CRIME had been committed by these criminals!!
You as a potential investor of Sonora real estate should be asking yourself; “Is it really worth it to invest good, hard earned money in Sonora??

El Golfo’s elusive fugitives are still being sought since October 5, 2007. These three accused model citizens have been able to evade capture but have LOST all federal amparos as well (federal court protections like an injunction)!! These guys are brave enought to use a well armed mob to throw us off our land but are now cowards when it comes time to face the rule of law!

I apologize for the large file that I had previously posted. I was informed that the meat of the rulling is really from page 57 on so I post that here so you won’t have to wait for the MUCH LARGER previous PDF file that 819 viewers have downloaded in the past two days.
Additionally, as I wait for somebody to scan and send me a copy of the Criminal Complaint Procedures definition of “Despojo” for the State of Sonora ( I can’t find my own copy of the book). I can tell you that a MAJOR flaw in the judges conclusion is that he forgot to include in his thought process the part the law clearly states that any person that participates, supports or cooperates in the act of DESPOJO is GUILTY under ANY MEXICAN RULE OF LAW !!! (state or federal)
Even though that we met a higher standard of proof that we use here in America; proof that is called “BEYOND A REASONABLE DOUBT” we didn’t get a fair shake in the court system of Sonora (for what ever reason), we still have an appeal on file and after that we have the federal courts to remedy the injustice that we recieved in SONORA!
What is more perplexing is; why the executive branch still REFUSES to enforce arrest warrants for the remaining 3 defendants?? It has been almost 2 years since the orders were issued. The remaining three defendants have LOST thier federal “amparos” (a federal injunction) as did everybody else involved in this case! I even lost my amparo against the SONORA government to force them to carry out the arrest warrants. They still FREELY walk around town like they own it!
At the very least, I should have the pleasure of meeting them face to face in a courtroom where I can impeach their testimony like I had previously done with the other 4 defendants. Who knows, maybe they too, will be absolved of aqcuiring real esate the old fashioned way, by using force to STEAL IT!!!

The local state prosecutor of Division 2 for the State of Sonora in San Luis Rio Colorado has been fired. Although I am not at liberty to discuss specifics on the matter, I can say that it has major implications for the investors of El Golfo beach real estate. More will follow in the coming days. We still wit for the decision of the Penal judge (case #170/07)as to guilt or innocence and we still have not seen indictments issued for our squatters.
In three weeks we will be joyfully celebrating the 4th anniversary of all of our problems with this cancer or AKA criminal group trying to pss themselves off as peaceful, law abiding citizens!

All eyes are on the Criminal Court out of San Luis Rio Colorado. The judge is to rule on the guilt or innocence of the defendants (case # 170/07) and what their sentence will be (if any). He should rule this week!! This is by far, the most important upcoming news. Will justice prevail??? The million dollar question!!!
Several people have written to me asking me to update the Spanish version of this blog. Unfortunately, I find it too difficult to express myself and still contain the anger, frustration and contempt I feel for certain circumstances, agencies and some people (politicians included on both sides of the border). To that end, I will not continue the Spanish version and plan to take it down once we are back on our legally purchased and titled land and the cancer is dealt with in El Golfo! Hopefully, it will not be too much longer.
